1. What ProdForm is
ProdForm is a SaaS platform for commercial product testing: setting up blind tests, managing participants, collecting data and reporting. The service is delivered "as is" and is continuously improved. We reserve the right to change, add or remove functionality, but will give reasonable notice before retiring features that are central to customer use.
2. Account and responsibility
You must be at least 18 to create an account. You are responsible for keeping login details secret and for all activity on the account. If you suspect unauthorised access, notify us immediately. You must provide correct and up-to-date information, and not use the service for unlawful purposes, to spread harmful content or to attempt to breach platform security.
3. Participants and your obligations
When you use the platform to collect data from participants, you are the data controller and ProdForm is the processor. You must: (a) have a valid legal basis for the processing, (b) inform participants what is collected and why, (c) obtain consent where required, (d) not request special categories of personal data without first clearing it with ProdForm, (e) handle participant access and erasure requests within statutory deadlines. The Data Processing Agreement (DPA) forms part of these terms and applies automatically.
4. Subscription and payment
During the MVP phase the service may be offered free of charge or on pilot terms by individual agreement. When commercial plans launch, the prices and terms published or agreed at the time of order apply. Invoicing is in advance per period. Price changes are notified at least 60 days before they take effect. In case of non-payment the service may be suspended after a reminder.
5. Data ownership
You retain all rights to data that you or your participants generate in the platform ("Customer Data"). ProdForm has a limited right to process Customer Data to deliver the service. We may use aggregated and anonymised data — where individuals and organisations cannot be identified — to improve the service and publish industry insights. We do not sell Customer Data.
6. AI features
The platform contains AI-powered features (analysis, suggestions, report generation). AI output is an aid, not a final answer — you must assess quality and relevance before using results to make decisions. Text and data sent to AI features may be processed by Anthropic as a sub-processor. We do not use customer data to train general-purpose AI models.
7. Availability and support
We aim for high uptime but provide no formal SLA during the MVP phase. Planned maintenance is announced in advance where practical. Support is provided by email during normal business hours (CET). Commercial plans may include guaranteed uptime and response times — these are set in a separate agreement.
8. Limitation of liability
The service is provided without warranties beyond those required by mandatory law. ProdForm is not liable for indirect losses, including lost profit, lost goodwill or losses caused by delay. Total liability for direct losses is limited to the amount the customer has paid for the service in the past 12 months. The limit does not apply in case of intent or gross negligence.
9. Termination
Either party may terminate the agreement in writing with 30 days' notice. On termination you can export your data for 30 days after the agreement ends. After this Customer Data is deleted within 30 days (backups included), except where we are required by law to retain data. ProdForm may suspend or terminate accounts on material breach of these terms, with prior notice where reasonable.
10. Governing law and jurisdiction
These terms are governed by Norwegian law. Disputes shall be attempted resolved through negotiation. If agreement is not reached, Oslo District Court is the venue. Consumers retain mandatory rights under the consumer law of their country of residence.
11. Changes to these terms
We may update the terms. Material changes are notified by email at least 30 days before they take effect. Continued use after the change constitutes acceptance. Earlier versions are available on request via kontakt@prodform.no.
